Online Reservation Terms & Conditions
This page sets out the Terms and Conditions under which you are able (subject to availability) to make an online Reservations for a new BYD car which has not yet been manufactured and/or delivered to us by the manufacturer.
Please note that these Terms only apply to Reservations and do not apply to the purchase of a new BYD car which is available for immediate delivery from our current stock. The terms on which you can purchase an available BYD car are at your reach through another purchase journey.
Please read these Terms carefully and make sure that you understand them. By ticking the box confirming your acceptance of these Terms you agree to be bound by them. If you do not accept these Terms, you will not be able to make the Reservation for the BYD car. You must be a resident of the United Arab Emirates in order to make a Reservation and accept these Terms.

1-    HOW TO MAKE AN ONLINE RESERVATION FOR A NEW BYD

a.    You can make a Reservation by: (a) completing the online process; and (b) paying a refundable deposit amount at the time of the Reservation. 
b.    Our online process will guide you through the steps you need to take. Please take the time to read and check your Reservation at each page of the process.
c.    After you make your Reservation, we will send you an email acknowledging that we have received your Reservation and confirming that it has been accepted (“Reservation Confirmation”). Each Reservation Confirmation will have its own, unique order number.
d.    If you do not receive the Reservation Confirmation within 24 hours of completing the online process.
e.    If we are unable to accept your Reservation for any reason, we will inform you and our only liability will be to refund the Deposit, if already paid.
f.    Your Reservation is not transferable or assignable.

2-    The Deposit

a.    Your Deposit is collected by us. 
b.    The Deposit is payable by credit / debit card, Apple Pay and Samsung Pay. 
c.    You are responsible for verifying that the payment transaction has been successfully completed. The Reservation will only be processed after the payment transaction for the Deposit is completed. 
d.    The Deposit is fully refundable if you decide (before delivery and/ or registration of the new BYD car in your name) not to proceed with the purchase of your new BYD car. 

3-    COMPLETING THE PURCHASE OF YOUR NEW BYD 

a.    After paying your Deposit, you will receive an email with your order details. If you wish to discuss pricing, adding optional features to the new BYD car or financing options, you can contact us. 
b.    We will let you know when your new BYD car is available for delivery (“Available Delivery Date”). We make no guarantee or commitment as to when the Available Delivery Date will occur, and you agree we will not be liable to you for any loss or damage you suffer if delivery is delayed beyond any estimated date provided for any reason.
c.    To complete the purchase of your new BYD car you will need to enter into a contract for sale with us on or before delivery. The contract for sale will record all the terms of the sale and purchase between you and us including final price, payment terms, delivery and warranty. The Deposit will be credited towards the final price payable under the contract for sale.
d.    If you do not enter a contract for sale and take delivery of your new BYD car and permit us to register it in your name within 2 weeks of the Available Delivery Date, your Reservation will lapse and the Deposit will be refunded to you. 

4-    OUR RIGHT TO VARY THESE TERMS

a.    We may revise these Terms as they apply to the Reservation from time to time to reflect changes in relevant laws and regulatory requirements. 
b.    If we have to revise these Terms as they apply to your Reservation, we will contact you to give you reasonable advance notice of the changes.

5-    CANCELLATION OF THE RESERVATION AND REFUND OF DEPOSIT

a.    You may cancel your Reservation for any reason by notifying us at any time before you take delivery of your new BYD car and/or registration of the new BYD car under your name .
b.    If you cancel your Reservation or your Reservation lapses as set out in Section 3d your Deposit will be refunded. 
c.    We may cancel your Reservation if the manufacturer discontinues the manufacture or supply to us, or if we cease to stock, cars of the same type/model as the new BYD car to which your Reservation relates.  We will inform you of cancellation as soon as possible, and our only liability will be to refund the Deposit.
d.    No court order is required to cancel a Reservation. Deposit refunds will be processed within 5-7 business days.

6-    EVENTS OUTSIDE OUR CONTROL 

a.    We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under these Terms that is caused by an Event Outside Our Control. An “Event Outside Our Control” is any act or event beyond our reasonable control. 
b.    If an Event Outside Our Control takes place that affects the performance of our obligations under these Terms: (a) we will contact you as soon as reasonably possible to notify you; and (b) our obligations will be suspended and the time for performance of our obligations will be extended for the duration of the Event Outside Our Control. 
c.    You may cancel the Reservation in accordance with Section 5 if it is affected by an Event Outside Our Control. 

7-    USE OF OUR WEBSITE
Your use of our website is also governed by the other terms and conditions on the site including “Privacy Policy”, “Terms And Conditions” and “Cookies Policy”. Please take the time to read these, as they include important terms which apply to you.

8-    COMMUNICATION
If we have to contact you or give you notice in writing, we will do so by phone, e-mail or by prepaid post to the address you provide to us during the Reservation process.

9-    GOVERNING LAW
These Terms and the Reservation will be governed by the laws of the United Arab Emirates and all claims will be subject to the exclusive jurisdiction of the Dubai Courts.
